4. Prohibited Activities

4.1 STRICTLY PROHIBITED - IMMEDIATE TERMINATION

Users are absolutely forbidden from using the Service for:

A) Phishing, Fraud, and Scams

• Fake login pages impersonating banks, social media platforms, payment services, or other legitimate entities
• Investment scams, Ponzi schemes, or "get rich quick" schemes
• Romance scams, catfishing, or deceptive relationship schemes
• Cryptocurrency fraud or fake trading platforms
• Fake prize giveaways, lottery scams, or sweepstakes fraud
• Payment fraud, credit card scams, or identity theft
• Tech support scams or fake customer service operations

B) Impersonation and Deceptive Content

• Impersonating individuals, businesses, brands, or organizations
• False claims of affiliation with legitimate entities
• Misleading product sales or counterfeit goods
• False promises of earnings, prizes, rewards, or benefits
• Fake news, disinformation, or deliberately misleading content
• Fake reviews, testimonials, or endorsements

C) Malicious Activities

• Distributing malware, viruses, trojans, ransomware, or other harmful software
• Phishing attacks or credential harvesting
• Hacking tools or services
• Exploits targeting security vulnerabilities
• Denial-of-service (DoS) attacks or similar disruptions
• Unauthorized access to computer systems or networks

D) Spam and Abuse

• Mass distribution of unsolicited links or messages
• Automated account creation or bot activity
• Circumventing blocks, bans, or restrictions
• Email bombing or SMS flooding
• Comment spam or forum spam

4.2 Additional Prohibited Activities

Users must not:

A) Illegal Content and Activities

• Violate Swedish, EU, or international law
• Promote or facilitate terrorism or violent extremism
• Child exploitation material (CSAM) or grooming
• Human trafficking or exploitation
• Sale of illegal drugs, weapons, or controlled substances
• Money laundering or financing of illegal activities

B) Intellectual Property Violations

• Copyright infringement or pirated content
• Trademark violations
• Distribution of leaked or stolen proprietary information
• Unauthorized use of copyrighted materials

C) Harmful Content

• Harassment, stalking, or doxxing
• Hate speech or discriminatory content based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Violent or graphic content intended to shock or harm
• Self-harm or suicide promotion
• Non-consensual intimate imagery (revenge porn)

D) Regulated Activities Without Proper Licensing

• Adult content without age verification mechanisms
• Gambling, betting, or lottery services
• Financial services or investment advice
• Medical or pharmaceutical services

E) Platform Abuse

• Attempting to scrape, harvest, or collect User data
• Reverse engineering or attempting to access the Service's source code
• Creating multiple accounts to evade restrictions
• Interfering with the Service's operation or security
• Exploiting bugs or vulnerabilities without responsible disclosure

4.3 Adult Content - Special Requirements

A) Permitted Adult Content (OF Plan Only)

Adult content is ONLY permitted for users on the OF Plan ($3.99/month) and must comply with ALL of the following requirements:

The following types of adult content are ABSOLUTELY FORBIDDEN and will result in immediate permanent ban:

• Child Sexual Abuse Material (CSAM) - Zero tolerance, reported to NCMEC and law enforcement immediately
• Non-consensual content - Revenge porn, deepfakes, hidden camera footage
• Underage participants - Anyone under 18 in sexually suggestive content
• Bestiality or zoophilia
• Incest content (real or simulated with related individuals)
• Rape, sexual violence, or coercion (real or realistically simulated)
• Necrophilia content
• Scat, vomit, or extreme bodily fluids (beyond normal adult content)
• Self-harm in sexual contexts
• Drugged or unconscious individuals
• Trafficking or exploitation - Content suggesting coercion or payment exploitation

D) Content Teaser & Blur Function Rules

When using Content Teaser blocks with blur functionality:

• ✅ Blur level must be sufficient to obscure explicit content
• ✅ Teaser images must not show explicit genitalia, penetration, or extreme acts
• ✅ Destination links must direct to legitimate adult platforms (OnlyFans, Fansly, etc.)
• ✅ No misleading or deceptive teaser content
• 🚫 Do NOT use teasers to bypass age gate requirements
• 🚫 Do NOT use teasers for illegal content promotion

E) Platform Integration Requirements

For adult content creators, external links must only direct to:

• ✅ OnlyFans, Fansly, or other legitimate adult creator platforms
• ✅ Wishlist services (Amazon, Throne.me)
• ✅ Social media accounts (Instagram, Twitter, TikTok)
• ✅ Payment processors (PayPal, CashApp, Venmo)
• 🚫 No direct illegal adult content hosting
• 🚫 No pirated or stolen content

F) Free Plan Restrictions

Bio-Link.se employs industry-leading automated security systems:

• Google Safe Browsing API – Real-time protection against phishing and malware
• VirusTotal Multi-Engine Scanning – 97 security engines scan links daily
• Automated Link Monitoring – All shortened URLs and bio pages are scanned continuously
• Phishing Pattern Detection – AI-powered identification of suspicious content
• Automatic Blocking – Malicious links are redirected to security warnings immediately

5.2 Daily Automated Scanning

Our system performs:

• Daily scans of all active shortened URLs (03:00 UTC)
• Daily scans of all bio page content (04:00 UTC)
• Real-time monitoring of newly created links
• Continuous threat intelligence updates

5.3 User Flagging and Notification

When malicious content is detected:

• The User account is automatically flagged
• Admin notifications are sent within minutes
• Links are redirected to security warning pages
• Access may be suspended pending investigation

5.4 Adult Content Monitoring

For bio pages with adult content, we implement additional safeguards:

• Age Gate Verification – System checks that Age Gate block is present and properly configured
• Content Review Queue – New adult content bio pages may undergo manual review
• User Reports – Simplified reporting for inappropriate adult content
• Pattern Detection – AI monitoring for prohibited content types
• Compliance Checks – Regular audits of OF Plan accounts for Terms compliance

6. Enforcement and Penalties

6.1 Immediate Actions

Upon detection of violations, we will take the following actions without prior notice:

• Account Termination – Permanent suspension of your account
• Content Removal – Immediate deletion of all bio pages, shortened URLs, and associated data
• IP Blocking – Your IP address and related IP ranges will be permanently banned
• Data Retention – We retain logs, evidence, and User information for potential legal proceedings
• Age Gate Violations – Adult content without proper age verification results in immediate suspension and content removal
• Reporting – Suspected criminal activity will be reported to:
  • Local law enforcement
  • Interpol or Europol (for international cases)
  • Fraud prevention agencies
  • Financial institutions (for payment fraud)

6.2 No Warnings Policy

6.3 No Refunds or Data Recovery

Accounts terminated for Terms violations are not eligible for:

• Data recovery or backup provision
• Refunds of any payments made
• Account reinstatement or appeals
• Transfer of Content to another platform

6.4 Legal Consequences

Users acknowledge that:

• Violations may constitute criminal offenses in Sweden, the EU, or your local jurisdiction
• We cooperate fully with law enforcement investigations
• You may face civil or criminal liability for your actions
• We may pursue legal action to recover damages

7. Reporting Violations

7.1 How to Report

If you encounter suspected violations on our platform, please report immediately:

Include in your report:

• The suspected violating URL or bio page
• Description of the violation
• Screenshots or evidence (if available)
• Your contact information (optional but helpful)

7.2 Whistleblower Protection

We protect the identity of reporters and do not disclose personal information except where legally required.

8. Monitoring and Transparency

We actively monitor the Service and reserve the right to:

• Review any Content at any time
• Use automated scanning tools to detect violations
• Block IP ranges associated with fraudulent activity
• Implement additional verification for high-risk regions
• Remove Content that appears suspicious, even without explicit violations

8.2 Transparency

We publish security statistics and threat reports:

• Monthly security reports (available on request)
• Public security page: https://bio-link.se/custom/safety-security/
• Annual transparency reports detailing enforcement actions

8.3 Data Logging

We log the following for security purposes:

• IP addresses and geolocation data
• Timestamps of Content creation and access
• Browser and device information
• Link click data and referral sources
• Security scan results

Log retention period: Minimum 12 months, longer for legal proceedings.

9. User Responsibilities

9.1 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of unauthorized access
• Using strong, unique passwords

9.2 Compliance

You agree to:

• Comply with all applicable laws and regulations
• Respect intellectual property rights
• Ensure accuracy of information provided
• Monitor and moderate Content you publish
• Cooperate with investigations

9.3 Age Requirement

9A. Subscription Plans & Adult Content Access

9A.1 Plan Tiers

Bio-Link.se offers three subscription tiers:

Users found creating adult content on Free or Premium plans will:

• Receive one warning email
• Have 48 hours to upgrade to OF Plan or remove adult content
• Face account suspension if non-compliant after 48 hours

9A.4 Refunds for OF Plan

OF Plan subscriptions are non-refundable if:

• Account is terminated for Terms violations
• Adult content guidelines are violated
• Age Gate requirements are not met

Standard refund policy applies for other cases (see Section 15).

10. Intellectual Property

10.1 Service Ownership

All rights, title, and interest in the Service, including software, design, trademarks, and Content created by Bio-Link.se, are owned by us.

10.2 User Content License

By uploading Content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Host, store, and display your Content
• Scan and analyze Content for security purposes
• Create backups and caches
• Moderate and remove Content if necessary

You retain ownership of your Content.

10.3 Trademark

"Bio-Link.se" and our logo are trademarks. You may not use them without written permission.

11. Limitation of Liability

11.1 Service "As Is"

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

11.2 Disclaimer

We are not liable for:

• Third-party Content accessed through shortened URLs
• Business losses due to account suspension or termination
• Data loss resulting from violations
• Indirect, incidental, consequential, or punitive damages
• Actions taken by law enforcement based on our reports

11.3 Third-Party Links

We are not responsible for third-party websites or services linked through our platform. Users access them at their own risk.

12. Indemnification

You agree to indemnify and hold harmless Bio-Link.se, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you publish on the Service

13. Privacy and Data Protection

Our Privacy Policy explains how we collect, use, and protect your data, including how we share data with our email service provider (Mailjet SAS) for newsletter and system communications. By using the Service, you consent to our data practices.

• If your account is inactive for 2+ years

• All Content is deleted (subject to legal retention)
• Shortened URLs become inactive
• No refunds are provided (unless legally required)

16. Governing Law and Jurisdiction

16.1 Swedish Law

These Terms are governed by the laws of Sweden, without regard to conflict of law principles.

16.2 Jurisdiction

Any disputes arising from these Terms or the Service will be resolved exclusively in the courts of Sweden. You consent to Swedish jurisdiction regardless of your location.

16.3 EU Users

EU Users retain consumer protection rights under EU law, including the right to bring proceedings in their country of residence.

16.4 Dispute Resolution

Before filing a lawsuit, you agree to:

• Contact us to resolve the issue informally
• Participate in good-faith negotiations for 30 days
• Consider mediation or arbitration

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements, constitute the entire agreement between you and Bio-Link.se.

17.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

17.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

17.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms to any successor or affiliate.

17.5 Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control (e.g., natural disasters, wars, pandemics).

17.6 Language

These Terms are provided in English. Translations are for convenience only. In case of conflict, the English version prevails.
